Welcome to Nicole Gaviria Therapy LLC (“Company,” “we,” “our,” “us”). These Terms & Conditions (“Terms”) govern your access to and participation in our therapy, coaching programs, digital products, online courses, and community spaces.

By purchasing, enrolling in, or accessing any of our services, you confirm that you have read, understood, and agreed to these Terms.

1. SERVICES OFFERED

Nicole Gaviria Therapy LLC provides the following services:

  • One-on-One Therapy
  • Online Group Coaching Programs
  • Self-Led Online Courses & Digital Programs
  • Digital Products, Educational Resources & Workshops

2. COACHING VS THERAPY DISTINCTION

Group Coaching & Self-Led Programs

  • All group coaching programs and self-led programs are delivered in a coaching and educational capacity only.
  • These programs do not constitute personalised mental health treatment, psychotherapy, diagnosis, or medical care.
  • Participation does not create a therapist-client relationship between you and Nicole Gaviria.

One-on-One Therapy

  • A therapeutic relationship only exists when you are formally contracted for one-on-one therapy services.
  • Different clinical, ethical, and legal obligations apply to therapy clients, and are governed by separate therapy-specific agreements.

3. PROGRAM ELIGIBILITY & ACCEPTANCE

  • Entry into The Break Up program is application-based.
  • By submitting an application, you confirm that all information provided is accurate and complete.
  • We reserve the right to:
    • Decline an application
    • Remove a participant
    • Terminate access at any time

This may occur if:

  • Your needs exceed the scope of a coaching-based program
  • Group participation becomes unsafe or inappropriate
  • Group guidelines are violated
  • Information on your application is found to be inaccurate

Removal under these circumstances does not automatically qualify for a refund. This is at our discretion.

4. CLIENT RESPONSIBILITIES

For One-on-One Therapy & Coaching Clients:

  • Payment must be made in advance
  • Minimum 24 hours’ notice is required for cancellations
  • Missed sessions or late cancellations are non-refundable.

For Online Courses & Group Coaching Clients:

  • Results depend on your personal engagement and application
  • Group spaces must remain safe, respectful, and confidential
  • Harassment, bullying, unsafe behaviour, or boundary violations will result in immediate removal without refund
  • You agree not to share or distribute confidential group discussions

5. COMMUNITY & GROUP GUIDELINES

All program participants must:

  • Respect community boundaries
  • Maintain confidentiality
  • Avoid harmful, triggering, or inappropriate content
  • Follow moderator direction

Failure to follow community guidelines may result in immediate removal without refund.

6. CONFIDENTIALITY & PRIVACY

  • We comply with New Zealand Privacy Law
  • Coaching spaces are confidential except where required by law
  • Payment details are securely processed via Stripe
  • You are responsible for maintaining the privacy of your login information

7. USE OF WINS, STORIES & TESTIMONIALS (MARKETING CONSENT)

By enrolling in any program, you grant consent for Nicole Gaviria Therapy LLC to share anonymised wins, progress updates, reflections, and celebrations for marketing and educational purposes.

This includes:

  • Website
  • Social media
  • Emails
  • Promotional materials

Strict protections apply:

  • Pseudonyms will always be used
  • No identifying information will ever be shared
  • Stories are used with the intention of celebrating progress and demonstrating program effectiveness

If you wish to withdraw this consent at any time, you may do so in writing via email.

8. INTELLECTUAL PROPERTY

All content provided is the exclusive property of Nicole Gaviria Therapy LLC including:

  • Videos, audios, PDFs
  • Worksheets, resources, handbooks
  • Trainings, libraries, bonuses

You may not reproduce, distribute, resell, or share materials under any circumstances.

Violation may result in immediate termination and legal action.

9. REFUND & CANCELLATION POLICY

One-on-One Therapy Support Packages

  • After the first session, remaining unused sessions may be refunded if either party deems the relationship unsuitable
  • Missed sessions without proper notice are charged in full

Self-Led Programs & Digital Courses (Including The Break Up)

We offer a 14-day conditional refund policy.

It’s really important to me that you feel safe making this investment, and so because of that I offer a money back guarantee. What does this mean exactly? It means that if this program is not right for you, you are able to access a refund within 14 days of purchasing this program. You simply need to demonstrate that you have completed the first two module videos( Reset + Reclaim, Cravings Chaos and Coping) and completed worksheets and if in doing so, you don’t see the value in the program, the refund is yours (though we doubt that will happen after you see what’s inside). This guarantee ensures our community is filled with serious, committed individuals, creating a better experience for everyone. If you’re not ready to put in the work, this program isn’t for you – and that’s ok.

To qualify for a refund:

  • You must complete at least two (2) modules
  • You must return your completed worksheets as proof of effort
  • You must email your refund request and evidence within 14 days of purchase
  • The request must include your completed work and evidence of implementation

Refunds are not granted for non-participation or disengagement due to the nature of this digital product and your full access to the program during that time.

Group Coaching Programs

  • No refunds once the program has commenced
  • Missed calls do not qualify for refunds
  • Removal for breach of guidelines voids refund eligibility

10. BILLING & PAYMENT AGREEMENT

  • All services are paid in full or via approved payment plans
  • Payment plans must be completed regardless of participation
  • Accepted methods: Stripe, Bank Transfer (NZ only)

Late Payments

  • $15 NZD late fee after 7 days
  • Access suspended after 14 days overdue
  • Accounts overdue 30+ days may be sent to collections

11. CHARGEBACK & DISPUTE RESOLUTION

  • Chargebacks filed without contacting us first will result in immediate service termination
  • Fraudulent disputes will be contested through Stripe

12. LIABILITY DISCLAIMER

  • Coaching and educational services do not replace medical or psychiatric treatment
  • Participation is voluntary
  • Results are not guaranteed
  • We are not liable for direct or indirect consequences of program participation

13. TERMINATION POLICY

We reserve the right to terminate access for:

  • Non-payment
  • Behavioural violations
  • Safety concerns
  • Breach of any Terms

Termination under these conditions does not qualify for a refund.

14. MODIFICATIONS TO TERMS

We may update these Terms at any time. Continued use of services means you accept the latest version.
