Welcome to Nicole Gaviria Therapy LLC (“Company,” “we,” “our,” “us”). These Terms & Conditions (“Terms”) govern your access to and participation in our therapy, coaching programs, digital products, online courses, and community spaces.

By purchasing, enrolling in, or accessing any of our services, you confirm that you have read, understood, and agreed to these Terms.

1. SERVICES OFFERED

Nicole Gaviria Therapy LLC provides the following services:

One-on-One Therapy
Live Group Coaching Programs
Digital Products, Educational Resources & Workshops

2. COACHING VS THERAPY DISTINCTION

Group Coaching Programs

All group coaching programs are delivered in a coaching and educational capacity only.
These programs do not constitute personalised mental health treatment, psychotherapy, diagnosis, or medical care.
Participation does not create a therapist-client relationship between you and Nicole Gaviria.

One-on-One Therapy

A therapeutic relationship only exists when you are formally contracted for one-on-one therapy services.
Different clinical, ethical, and legal obligations apply to therapy clients, and are governed by separate therapy-specific agreements.

3. PROGRAM ELIGIBILITY & ACCEPTANCE

Entry into The Break Up program is by purchase or application; however, we reserve the right to:

Decline an application
Remove a participant
Terminate access at any time

This may occur if:

Your needs exceed the scope of the program
Participation becomes unsafe or inappropriate
Group guidelines are violated
Information on your application is found to be inaccurate

Removal under these circumstances does not automatically qualify for a refund. This is at our discretion.

4. THE BREAK UP: PROGRAM STRUCTURE

The Break Up is a 90-day live coaching container, priced at $2,500 AUD (or via an approved 6 x $430 AUD/month payment plan), designed to support clients toward binge-free results within those 90 days. Promotional or founding pricing may be offered for specific cohorts at Nicole Gaviria Therapy LLC’s discretion and will be communicated at the time of enrolment.

The base container includes: a live onboarding call, bi-weekly hot seat coaching calls, monthly live workshops, and community forum access, all provided for 90 days from the date of the live onboarding call. Curriculum access (8 modules) is provided for 6 months from enrolment. Certain bonus resources (including the handbook, worksheets, and AI coach tool) are provided with lifetime access as stated at the time of purchase.

The Inner Circle upgrade is a separate paid tier, currently priced at $3,000 AUD (or via an approved 6 x $500 AUD/month payment plan), limited to 5 active participants at any time. Inner Circle clients receive live coaching, hot seat, and community access for the full 6-month duration of their container from enrolment (rather than the 90-day base term), plus 4 private 60-75 minute 1:1 sessions with Nicole across that period.

5. THE 90-DAY CHECK-IN AND EXTENSION

The Break Up is designed to support clients toward binge-free results within 90 days of enrolment. Every client receives a complimentary private 30-minute 1:1 check-in session with Nicole at the 90-day mark of her container, regardless of progress made.

Where a client has not yet reached binge-free by this point, she may be offered a further 90 days of live coaching and community access at no additional cost (bringing her total container to 6 months), provided she has genuinely engaged with the program across her original 90 days. Engagement is assessed by Nicole, in good faith, based on visible participation, including:

Engagement with live calls — either attending live or watching the replay within 7 days of each session
Completion of curriculum modules and their corresponding worksheets
Completion of the Recovery Score™ Tracker
Active use of the community forum, including asking for help and support when stuck

This is a good-faith judgement call made by Nicole based on overall engagement, not a rigid box-ticking exercise. This extension does not apply to Inner Circle clients, whose containers already run for 6 months from enrolment.

This provision does not constitute a promise or guarantee of specific clinical outcomes. Individual results vary based on engagement, personal circumstances, and consistent application of program material, consistent with Section 14 (Liability Disclaimer) below.

6. CLIENT RESPONSIBILITIES

For One-on-One Therapy & Coaching Clients:

Payment must be made in advance
Minimum 24 hours’ notice is required for cancellations
Missed sessions or late cancellations are non-refundable

For Group Coaching Clients:

Results depend on your personal engagement and application
Group spaces must remain safe, respectful, and confidential
Harassment, bullying, unsafe behaviour, or boundary violations will result in immediate removal without refund
You agree not to share or distribute confidential group discussions

7. COMMUNITY & GROUP GUIDELINES

All program participants must:

Respect community boundaries
Maintain confidentiality
Avoid harmful, triggering, or inappropriate content
Follow moderator direction

Failure to follow community guidelines may result in immediate removal without refund.

8. CONFIDENTIALITY & PRIVACY

We comply with New Zealand Privacy Law
Coaching spaces are confidential except where required by law
Payment details are securely processed via Stripe
You are responsible for maintaining the privacy of your login information

9. USE OF WINS, STORIES & TESTIMONIALS (MARKETING CONSENT)

By enrolling in any program, you grant consent for Nicole Gaviria Therapy LLC to share anonymised wins, progress updates, reflections, and celebrations for marketing and educational purposes.

This includes:

Website
Social media
Emails
Promotional materials

Strict protections apply:

Pseudonyms will always be used
No identifying information will ever be shared
Stories are used with the intention of celebrating progress and demonstrating program effectiveness

If you wish to withdraw this consent at any time, you may do so in writing via email.

10. INTELLECTUAL PROPERTY

All content provided is the exclusive property of Nicole Gaviria Therapy LLC including:

Videos, audios, PDFs
Worksheets, resources, handbooks
Trainings, libraries, bonuses

You may not reproduce, distribute, resell, or share materials under any circumstances. Violation may result in immediate termination and legal action.

11. REFUND & CANCELLATION POLICY

One-on-One Therapy Support Packages

After the first session, remaining unused sessions may be refunded if either party deems the relationship unsuitable
Missed sessions without proper notice are charged in full

The Break Up — 14-Day Conditional Guarantee

It’s really important to me that you feel safe making this investment, so I offer a money-back guarantee on The Break Up specifically. If this program is not right for you, you can access a refund within 14 days of purchasing, provided you demonstrate that you have completed the first two module videos (Reset + Reclaim, Cravings Chaos and Coping) and their corresponding worksheets. If, having done so, you don’t see the value in the program, the refund is yours.

This guarantee ensures our community is filled with serious, committed individuals, creating a better experience for everyone. If you’re not ready to put in the work, this program isn’t for you — and that’s okay.

To qualify for a refund:

You must complete at least two (2) modules
You must return your completed worksheets as proof of effort
You must email your refund request and evidence within 14 days of purchase
The request must include your completed work and evidence of implementation

Refunds are not granted for non-participation or disengagement, due to the nature of this digital product and your full access to the program during that time. This 14-day window is the sole refund pathway for The Break Up; once it has passed, the general Group Coaching Programs policy below applies.

Other Group Coaching Programs

No refunds once the program has commenced
Missed calls do not qualify for refunds
Removal for breach of guidelines voids refund eligibility

12. BILLING & PAYMENT AGREEMENT

All prices for our services are listed in Australian Dollars (AUD).

All services must be paid via our website checkout, either in full or via an approved payment plan. Access to programs, live calls, and community spaces is granted only once payment has been successfully processed through checkout — enrolment is not confirmed and access is not provided prior to successful payment.

Accepted payment method: Stripe, via website checkout
The Break Up’s approved payment plan is 6 x $430 AUD/month (or the applicable founding/cohort rate where offered), plus a payment plan administration fee of [insert amount/percentage] to cover the additional processing and administrative costs of instalment billing
The Inner Circle’s approved payment plan is 6 x $500 AUD/month, subject to the same administration fee
Payment plans must be completed in full regardless of participation, progress, or continued engagement

Failed or Declined Payments

If a scheduled payment plan instalment fails or is declined, we will contact you to update your payment details and reprocess the payment. You will have 5 business days from the date of first contact to resolve the failed payment.

If payment is not successfully resolved within this window, your access to live calls, the community, and program materials will be suspended until the outstanding payment is received. Continued non-payment may result in termination of your enrolment; this does not waive your obligation to pay the remaining balance owed under your payment plan agreement.

13. CHARGEBACK & DISPUTE RESOLUTION

Chargebacks filed without contacting us first will result in immediate service termination
Fraudulent disputes will be contested through Stripe

14. LIABILITY DISCLAIMER

Coaching and educational services do not replace medical or psychiatric treatment
Participation is voluntary
Results are not guaranteed
We are not liable for direct or indirect consequences of program participation

15. TERMINATION POLICY

We reserve the right to terminate access for:

Non-payment
Behavioural violations
Safety concerns
Breach of any Terms

Termination under these conditions does not qualify for a refund.

16. MODIFICATIONS TO TERMS

We may update these Terms at any time. Continued use of services means you accept the latest version.
